In a case pending in the New York District Court in New York City, Katten represents InMarket Media LLC and was successful in defeating a motion filed by Berkley Networks Corp. seeking to stop it from using the “inMarket” trademark for its mobile marketing platform delivered to smart phones. The federal judge ruled that Berkley Networks cannot get swift court action after years of “lassitude.” The Katten attorneys who represented InMarket Media include Floyd Mandell, national co-chair of Katten’s Intellectual Property practice, New York Intellectual Property associate Jessica Garrett, and Chicago Intellectual Property associates Jeffrey Wakolbinger and Julia Kasper.
