The Second Circuit Court of Appeals again affirmed a New York federal court’s dismissal of a copyright infringement suit brought against NBCUniversal Media, LLC and Reveille LLC by a woman alleging that the network and production company had stolen her idea for their TV show The Biggest Loser. The Second Circuit had previously ruled that the woman had not demonstrated that further discovery would have uncovered new evidence to support her claim, and rejected this second appeal stating the “allegedly new evidence could not possibly alter the outcome of the case.” Litigators Joel Weiner, Alan Friedman, Dean Razavi and Gail Migdal Title represented NBC and Reveille.
