Michael Callahan, a partner in the firm’s Health Care Practice, was quoted in an article in Medical Staff Briefing on the reversal of the Kadlec decision and its effect on hospitals’ exclusive contracts with physicians. In the article, Mr. Callahan points out that because of the clean sweep provisions in exclusive contracts in which terminated physicians waive their hearing rights, suspicions of impairment or quality problems usually are not as thoroughly investigated as is the case when there is formal disciplinary action and a hearing. Therefore, these physicians are rarely reported to state licensing boards or to the Data Bank, which allows them to move on to an unsuspecting hospital. (Medical Staff Briefing, July 2008)
