Partners Michael Callahan and J. Phillip O'Brien will speak at a webinar on "Debriefing on the FTC/CMS/OIG Workshop on the Legal Issues Related to Accountable Care Organizations (ACOs)" at 2:00 p.m. Central on Thursday, October 7. The webinar will review the October 5 FTC/CMS/OIG Workshop on the Legal Issues Related to Accountable Care Organizations (ACOs).

At this workshop, which will be held at CMS headquarters in Baltimore on October 5, representatives from CMS, FTC and OIG will address and solicit public comments on the legal issues presented by various ACO models under consideration by health care providers, including antitrust, physician self-referral, anti-kickback and civil monetary penalty laws related to ACOs.

Katten's October 7 webinar debriefing will provide a summary of the key points and issues addressed at the workshop, as well as an analysis related to those issues.

Topics that will be discussed at the webinar include:

  • How can different ACO structures affect price and quality of services delivered to publicly and privately insured?
  • How can the antitrust, anti-kickback, physician self-referral prohibitions and civil monetary penalty can be addressed in proposed CMS regulations?
  • Should FTC/CMS/OIG propose any safe harbors, exceptions, exemptions or waivers to federal laws to accommodate ACOs?
