This article examines a recent amendment to the Illinois Mechanics Lien Act, which permits owners, lenders and other lien claimants to bond over mechanics liens. Prior to the amendment, mechanics lien holders could cloud title to property for years by asserting disputed lien claims. Effective January 1, property owners and lenders can now bond over disputed liens, permitting lenders and property owners to sell or refinance properties without first paying off disputed lien claimants.
