We advise and represent a wide range of public and private sector employers across the country, including Fortune 500 companies and closely held businesses as well as governmental and tax-exempt entities.
Katten has a national reputation in designing and implementing employee health and welfare benefit plans, including self-funded, insured and managed health care plans, life insurance, disability plans, cafeteria plans, flexible spending accounts, and retiree medical plans. We negotiate insurance contracts and administrative services agreements, advise on the Patient Protection and Affordable Care Act (PPACA), Consolidated Omnibus Budget Reconciliation Act (COBRA), Health Insurance Portability and Accountability Act (HIPAA), Medicare Part D and other health care laws. Our representation of third-party administrators and other welfare plan service providers gives us unique insight into the industry, which enhances our ability to assist plan sponsor clients.
In our practice, we establish funding arrangements for medical, disability and other benefits, typically through tax-exempt voluntary employees' beneficiary associations (VEBAs), and assist clients as they design, document and operate health reimbursement arrangements (HRAs), including HRAs for individual employers and groups of employers.
We are frequently engaged for bespoke assignments such as the establishment of a trust for the funding of retiree welfare benefits, or funding benefits through an employer's captive insurance company.
