W. Kenneth Davis, Jr., a partner in the firm’s Health Care Practice, was quoted in a recent ImagingBiz.com article on which party should be responsible for transcription costs in imaging exams. While there have been attempts by hospitals to charge radiologists for transcription services in the past, radiologists, attorneys, and the American College of Radiology (ACR) have successfully overcome them by raising the specter of anti-kickback–statute violations. In the article, Mr. Davis noted that the Office of the Inspector General (OIG) has a different take on the issue. “The OIG said, ‘No, it’s not going to constitute an anti-kickback violation,” he says. “Essentially, they said, ‘Go forth and charge for transcription’,” (“A Thorny Question: Who is Responsible for Transcription Costs?,” March 18, 2008).
