Noah Balch focuses his practice on sports, health and nutrition, commercial litigation, entertainment, and protection and enforcement of intellectual property rights. An avid triathlete and life-long fitness advocate, Noah draws on this experience to counsel his clients on a variety of health, fitness and sports-related areas. He represents major league sports teams and athletic organizations, the Los Angeles 2024 Bid Committee for the Olympic and Paralympic Games, and film production companies. In addition, Noah handles sponsorship, tourism, branding and social media issues facing modern athletic organizations.
For nearly 10 years, Noah has litigated commercial lending and construction-related disputes in federal and state courts, and has co-chaired multiple jury trials. He also has briefed and argued at the California Courts of Appeal, and handled administrative law matters before city councils. When the economy experienced declines in the wake of the mortgage securities crisis, Noah took the lead on myriad commercial construction disputes for his lender clients. This included representing banks, REITs and quasi-government agencies in mechanics lien, stop notice and bond-related disputes. Based on his deep experience with construction law, Noah understands how to structure a commercial loan to safeguard disbursements and address entitlements and environmental review. When a dispute arises, Noah knows how to litigate claims, clear title and manage insurance-related issues.
Noah draws from a background in music and technology to maintain his entertainment practice. Before law school, he was a concert promoter and record label owner. His passion for music led him to publish “The Grey Note” in The Review of Litigation, an article about the legality of sampling in hip-hop and EDM. The government is still addressing this evolving landscape by considering fair-use sampling, and the US Court of Appeals for the Sixth and Ninth Circuits are split on the legality of even brief samples, making the subject matter of “The Grey Note” all the more relevant. Today, Noah protects, enforces and manages his client’s intellectual property portfolios with an ability to balance deft negotiating skills with assertive cease and desist efforts.
