Overview

Devon Downs concentrates her practice in environmental, health and safety (EHS) enforcement matters, and crisis management and workplace incident response involving federal and California laws. Devon routinely advises clients in connection with inspections by the California Division of Occupational Safety and Health Administration (Cal/OSHA) in response to workplace incidents or employee complaints. She has worked with several refineries in connection with Cal/OSHA's recently implemented process safety Program Quality Verification (PQV) inspections.

Devon has supported the response to multiple major workplace accident investigations by US Chemical Safety Board (CSB), US Environmental Protection Agency (EPA), and national Occupational Safety and Health Administration (OSHA). She counsels companies on post-incident evidence and site control processes and other aspects of government investigations. As part of responding to incidents, she works with clients to assess their process safety management compliance, integrity management practices, due diligence and other aspects of EHS performance. Devon also is experienced in general civil litigation and employment law, and she has counseled clients regarding trial and appellate strategy, taken and defended expert and lay depositions, and prepared and argued dispositive motions before the court.

  • Representation of a Fortune 100 chemical manufacturer in connection with a manufacturing accident that resulted in multiple serious injuries, including OSHA inspection and subsequent enforcement.
  • Representation of a midstream energy company in CSB, EPA and OSHA investigations following a plant fire.
  • Representation of one of the largest utilities in the United States regarding integrity management compliance issues and US Department of Transportation performance indicator benchmarking.
  • Representation of a multinational chemical company in connection with process safety management (PSM) site assessments at multiple manufacturing sites following a major accident.
  • Representation of an integrated energy company in a multi-agency investigation following a refinery explosion, including facilitation of evidence preservation and site control efforts.
  • Representation of a specialty truck fabrication company in a National Emphasis Program OSHA inspection.
  • Representation of an integrated energy company in a multi-agency investigation following a refinery fire, including investigations by the CSB, EPA, OSHA and the DOJ.
  • Representation of an integrated energy company in multiple state OSHA inspections, including local post-incident PSM compliance and safety culture audits.
  • Representation of one of the largest independent US refining companies in CSB and EPA investigations, in addition to defense of the company in multiple state OSHA inspections, some involving employee complaints and work stoppages.
  • Provision of assistance to clients in developing agency inspection response framework and employee training programs.
