Laura O’Connell and Nancy Rich, both partners in the Firm’s Environmental Practice, were quoted in a recent article in Product Liability Law360 on new and evolving issues in toxic tort litigation. Specifically, the article discussed the fact that scientists are increasingly able to show the presence of a wide range of chemicals in the human body, previously unknown or not detectable. Because of this, courts are beginning to face a new breed of toxic tort claims seeking to make pollution in people's bodies an actionable offense (“Toxic Trespass Could be the Next Big Toxic Tort,” November 16, 2007).
