Gary DeWaal, special counsel in the Financial Services group, commented to Law360 about continued focus by the US Commodity Futures Trading Commission (CFTC) on position rules to protect futures contracts classes. "They're trying to ensure there is a sensible definition of hedging, and what is the right level of limits," Gary said, adding that the CFTC wants "to ensure speculation is subject to the right kind of limits, but real hedging is not." He also noted that both the CFTC and the US Securities and Exchange Commission will face as-yet-unknown challenges posed by the new composition of the Congress.
