David Halberstadter, a partner in the Entertainment and Media practice, spoke with Daily Journal regarding potential copyright infringement of the Beastie Boys song “Girls.” GoldieBlox, an educational toymaker, rewrote all the lyrics to the song for an Internet commercial which it claims is a parody of the original’s misogynistic message, and therefore does not require the band’s permission. The company is so confident it will meet the criteria for fair use that it has instigated a legal battle by filing for a declaratory judgment and injunctive relief against the Beastie Boys—which David notes will require GoldieBlox to prove factors including purpose and character of the use in addition to amount and substantiality of the portion taken.
